Located at 9/101, GEETA COLONY, DELHI, East Delhi, Delhi, 110031. These Terms of Use ("Terms") govern your use of our website (https://www.shusshh.in/), our blog/newsletter "Shusshh Says," and all related services ("Platform"), including the purchase of wellness products ("Products") and access to informational content ("Information"). By accessing or using our Platform, you agree to be bound by these Terms and our Privacy Policy, Returns and Cancellation Policy, and other applicable rules and policies (collectively, "Policies").

2.1 Account Creation: You may create a SHUSSHH Account by providing your email ID, which may require authentication via a one-time password. Guest users may access limited features. You are responsible for maintaining the confidentiality of your account and accept all activities conducted through it.
2.2 Security: Notify us immediately if you suspect any unauthorized access to your SHUSSHH Account. We reserve the right to suspend or terminate your account if we suspect security breaches.
2.3 Termination: We may terminate your SHUSSHH Account and refuse service if you violate these Terms.
- Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use the Platform, Information, and Products for personal, non-commercial purposes. You may not download, copy, or modify the Platform or its content without our prior written consent.
- Product Description and Use
4.1 Accuracy: We strive to provide accurate Product descriptions but do not guarantee their completeness or reliability. Product images are illustrative and may not match the actual Product.
4.2 Use: Products are for personal use only and may not be resold or used for commercial purposes.

For health-related queries, consult a qualified healthcare provider. Information provided, including through "Ask the Sexpert," is for informational purposes only and not medical advice.
10.5 Usage of the Platform requires an active internet connection. We are not liable for any loss of functionality due to lack of internet access or for any associated charges from your mobile network provider. Additionally, ensure your device is adequately charged as we are not responsible for any inability to access the Platform due to battery depletion.
10.6 Your use of the Platform is at your own risk. We provide the Platform and its content "as is," without warranties of any kind, express or implied, including but not limited to, accuracy, reliability, uninterrupted provision, timeliness, security, or error-free operation.
10.7 While we endeavor to ensure content on the Platform complies with laws and respects third-party intellectual property rights, we are not an adjudicatory authority. Upon notification, we will review and potentially remove content within 36 hours if it violates these Terms.

- Restrictions and Use
14.1 You are solely responsible for any information you upload, post, or share on the Platform. Prohibited actions include illegal use, harm, fraud, impersonation, disrespect, infringement of rights, hate speech, solicitation of personal information, or dissemination of harmful content.
14.2 Other prohibited actions include hosting or sharing software viruses, misleading information, false news, or content that violates public order or national security.
14.3 Unauthorized commercial use, copying, reproduction, distribution, or exploitation of the Platform or content is prohibited without our written consent.
14.4 Actions implying endorsement by us are prohibited. Violations may result in account termination and legal action.
- Term and Termination
15.1 These Terms are effective until terminated by us or you. We may discontinue or modify the Platform or terminate these Terms with or without cause at any time.
15.2 Upon termination, you must cease using the Platform and certify removal of all copies. We may audit compliance.
- Electronic Communication
You consent to receiving communications electronically related to the Platform, Products, Information, and services. Communications may include notifications, promotions, and advertisements via email or push notifications.

17.2 Grievances are acknowledged within 24 hours and resolved within 15 days unless they pertain to specific content violations requiring expedited resolution.
- Survival
Sections 10 (Disclaimers), 11 (Intellectual Property), 12 (Limitation of Liability), 13 (Indemnification), 15 (Term and Termination), 17 (Grievance Officer), 18 (Survival), and 19 (General Provisions) survive termination of these Terms.
- General Provisions
19.1 We reserve the right to modify, suspend, or discontinue the Platform or Products without notice. Your continued use post modification constitutes acceptance.
19.2 Disputes are governed by Indian law, with exclusive jurisdiction in Mumbai. Disputes are resolved by arbitration under the Arbitration and Conciliation Act 1996, with Mumbai as the seat and English as the language.
19.3 Assignment of rights under these Terms is prohibited without consent. We may assign our rights without restriction.
19.4 Delay in exercising rights under these Terms does not waive them. Each exercise of rights is independent.
19.5 If any provision of these Terms is deemed illegal or unenforceable, remaining provisions remain valid.
19.6 Force majeure events beyond our control excuse non-compliance without affecting your statutory rights.
- SHUSSHH Program Terms and Conditions
20.1 Eligibility for the SHUSSHH Referral Program is limited to existing customers and new customers using a referral link.
20.5 SHUSSHH is not liable for technical issues related to the Referral Program beyond its control.
20.6 The Program is governed by Indian law, with disputes subject to Indian jurisdiction.
